G) PROFESSIONAL STANDARDS

  1. LEGAL FEES (approved Oct 4, 1995)
    The Professional Standards Committee is given the authority to incur legal fees when, at the discretion of the Chairperson, it is deemed necessary, so long as this procedure is not abused.
  2. MLS AUDITS (approved Nov 29, 2000)
    If a member has been fined for a basic MLS rule infraction that Firm’s listings will automatically be audited on a once per month basis for a period of 6 consecutive months.

3) Data Integrity Service
Incomplete, incorrect, or information not updated about an MLS® listing residing on the Board’s MLS® system has always been a concern to Members. Now there’s an easy way to report concerns without the Listing Office/Salesperson knowing who submitted the concern. The following depicts how members can submit a Correction to an MLS® Listing Anonymously. The following list of MLS® Data will appear on the Board’s Data Integrity Service – Corrections to MLS® Listings Anonymous Form

  1. MLS® Number
  2. Property Address (including postal address and 911 municipal address)
  3. Listing Brokerage
  4. Listing Salesperson
  5. Firm Sale Not Reported (add details)
  6. Conditional Sale Not Reported (add details)
  7. Identify Data alleged to be incorrect, missing or not updated
  8. Name and signature of Concerned Member
    A form letter will be issued immediately to the Listing Brokerage and the Listing Salesperson outlining the concern. The Listing Brokerage and/or Listing Salesperson will be required to correct the deficiency within 48 hours of receipt of the notice, (excluding Saturdays, Sundays, Holidays and Board closures). If the Listing Brokerage and Listing Salesperson do not comply with the requirements, then the matter will be submitted to the Professional Standards Committee to handle as an alleged breach of the Board’s by-laws, ARTICLE 9 The Member’s name, who submitted the original Data Integrity Service – Corrections to MLS® Listings Anonymous Form, will remain anonymous.

Data Integrity Service – Corrections Form

In accordance with Board Policies, Section G Professional Standards – Data Integrity Service. Incomplete, incorrect, or information not updated about an MLS® listing residing on the Board’s MLS® system has always been a concern to Members. Now there’s an easy way to report concerns without the Listing Office/Salesperson knowing who submitted the concern. The member can submit a Correction to an MLS® Listing and their name will be kept confidential. Identify the date alleged to be incorrect, missing, or not updated and describe the inconsistency below. Please include MLS® number and/or address of listing:

Data Integrity Reporting Procedures:

1. A form letter will be issued immediately to the Listing Brokerage and the Listing Salesperson outlining the concern. 2. The Listing Brokerage/Salesperson will be required to correct the deficiency within 48 hrs of receipt of the form letter, excluding weekends, holidays and Board closures. 3. If the Listing Brokerage/Salesperson does not comply with the requirements, then the matter will be submitted to the Professional Standards Committee to handle as an alleged breach of the Board’s MLS® Rules and Regulations. The Member’s name who submitted the original Data Integrity Service Corrections Form will remain anonymous.
